Neighbours extension

My neighbour is building a an extension abutting my shed wall.we have a party wall agreement re this .the problem is the flat roof fascia overhangs my pitched roof,he has without permission removed the ridge tiles and lowered the top row of slates to put the board on.he has then cut into my newly replaced render on my property to fit this into the wall .despite being Gwent a solicitors letter he has carried on and has know finished the roof.what are my chances of getting him to remove this and repair the damage

Wouldn’t know nor would anybody else on here know we’re not legal professionals on here unfortunately, we’re just trade people who can give views and advise on building issues not legal disputes I imagine if you take him to court you might be able to achieve this but I think it would be costly and take a long time it definitely wouldn’t happen soon going off my own family’s experience of arguing in court 2 years layer and 32k in fees and counting it’s very stressful and I wouldn’t advise to be honest as with our case the other side won’t be able to claim there cost back so there fees out weight what there going to have a chance of winning back so there no real benefit now it’s who ever got more money essentially.

I think this is not a question for a builder, you should seek proper legal advice.

It should state in the party wall agreement that any damage done to the adjacent building should be repaired by the builder. If not then the damaged party should seek legal advice as soon as possible.

Under party wall agreement your neighbour should have consulted with you about all aspects of the works particularly any work that was going to affect the fabric of your building. Not withstanding the above, the party wall
act is very specific about the responsibility put on your neighbour to ensure that your property is not unduly effected by his work any defect caused caused is his responsibility to put wright. If this went to court providing you have well documentary evidence ( photos before and after work completed) and any written agreement on the works being under taken then there is a good chance that you will win your case.you can also apply for any costs you have incurred during the your effects to resolve the matter this would be considered by the court only if you won your case.
