Party wall matters, am i covered?

Neighbour is building loft and rear extension. All party wall notices have been served and returned and surveyors appointed. I am the adjoining owner and my surveyor has completed the schedule of condition and sent a draft to the BO surveyor however no award has been given yet. Builders moved in and started notifiable works yesterday. I spoke with the surveyor who advised the building owner is the one at risk until the award is given, my surveyor is currently on holiday so cannot complete any amendments. Am I covered if anything goes wrong with the building work still?

Hello. Technically yes you are covered as you have done everything correct and the building owner is moving forward without the offical agreement between the two parties.
There is always a grey area in these matters as I am sure the building owner would try to argue the fact if the worst was to happen without the agreement fully signed.
I would recommend a polite email just stating you are uneasy that work has begun without without the agreement signed.

No the builder can’t start work till paper work is in and both parties agree if in doubt contact council

Regardless of any thing else all paperwork should be signed and passed. The easy way to look at it is t turn it around and ask yourself wat you would do if something went wrong
